Form 801 - Payment to Agency Report
Fair Political Practices Commission Form 801 is used to report certain payments received by state and local government agencies that are used for agency purposes and paid by a third party. It includes:
- a payment for an official’s travel expenses for the purpose of facilitating the public’s business in lieu of a payment using agency funds; and
- a payment that would otherwise be considered a gift or income to the benefiting official, but is instead accepted on behalf of the agency.
California Code of Regulations, title 2, sections 18944 and 18950.1, set forth the types of payments and circumstances for reporting. The Clerk of the Board maintains the Form 801s for the County. Within 30 days after the end of a calendar quarter, if aggregated reported travel payments total $2,500 or more, the Clerk of the Board posts the forms (or a summary) on its website. Additionally, within 30 days after the end of a calendar quarter, if aggregated reported non-travel payments total $2,500 or more, the Clerk of the Board posts the forms (or a summary) on its website.
